Pre-nuptial agreements generally define property rights for two individuals entering into a marriage. Such a contract usually addresses the following issues:
- The status of property each individual brought into a marriage.
- The status of property that the husband and/or wife acquires individually or jointly during the marriage.
- Issues of support and alimony, where applicable, should the marriage become dissolved.
- The ability of one spouse to leave all, something or nothing to the other in a Will or other testamentary instrument.
NOTE WELL: An individual’s Will CANNOT supersede the terms of a bona fide Pre-Nuptial Agreement without the consent of the other party.
